A bit of an update to the DADT saga

On Tuesday Virginia Phillips, a district judge in California, ordered an injunction against the enforcement of the "Don't Ask, Don't Tell" rule, on the basis that it violated the constitutional rights of gay troops, who can be dismissed if their sexuality is exposed.

Her ruling threatens an end to the 17-year-old law, which was introduced under the then-president Bill Clinton and has long been fiercely criticised by its numerous opponents.

Lawyers from the Department of Justice (DoJ) confirmed soon after the ruling that Barack Obama's administration would appeal against it, despite Mr Obama's pledge during his presidential campaign to scrap the law.

The US Defence Department said on Thursday that it had issued guidance to its commanders that the court order should be obeyed. Hours later, however, the DoJ confirmed it had asked for the ruling to be postponed.

A spokesman said the department was applying "for an order staying the application of the court's entry of a permanent injunction in this case pending appeal."

The "Don't Ask, Don't Tell" law is estimated to have resulted in the departure from the military of 14,000 qualified troops.

Mr Obama has ordered a year-long review of the potential implications of ending the ban. The review is due to be completed in December.

Robert Gates, the Defence Secretary, and Admiral Mike Mullen, the chairman of the joint chiefs of staff, also favour ending the law, but have said they would prefer it to be phased out slowly.

An internal Navy Memo stated that they've ceased all discharges based on DADT. Hopefully, the other branches will follow suit.

Senate voting on Don't ask, Don't tell Repeal, now

The US Senate is currently voting on repealing Don't Ask, Don't Tell and they've already passed the majority point for passing it. The House passed this stand alone bill earlier this week. It then has to be signed by the President. Although, there are some other loops to go through, but it looks like DADT is dead.

Hallelujah! Another large crack in the block of discrimination against LGBT people in the United States! This is GREAT news and I'm so excited for my friends in the military.

Now we just need to get rid of DOMA. :cheer:

This is a historical day for the glbt community. For the first time in American History, gay and lesbians will be able to serve openly. When people talk about DADT, they only refer to the 14,000 soldiers kicked out under the policy. Many don't realize that the first person kicked out of our military for being gay happened 232 years ago and the last 14,000 is only a small percent of the total.

im super happy for this, too bad i never kept up with my ex(due to the DADT policy) i wonder if he is still in the armed forces? hope so and hope hes happy about the decision

It will take a little while for the military to construct new policies and procedures, but today it became law, DADT is officially over.

You probably won't see it happen in the US at all. Theres a ban on protesting at all for anything in uniform. I could see Pride events being viewed as a political protest of sorts, so don't look for service members there.

I'm certain you'll see service members at all sorts of pride parades. However, you won't see them in uniform.
